Abbit v. ING US

Welcome to the Abbit v. ING USA Class Action Website

If you purchased a “Secure Index” annuity from ING USA Annuity and Life Insurance Company (also known as VOYA), you may be a member of a class of annuity purchasers certified by the United States District Court.

If you are a Class Member, this legal proceeding may affect your rights.

The District Court determined that certain claims are appropriate for class-wide adjudication in a single action, depending upon state of residence at the time of purchase. If you wish to pursue any claims that have not been certified by the District Court, you must bring a separate action for relief.

Case Update

On August 30, 2016, the Court granted Defendants’ Motion for Summary Judgment on all of the Class claims.  On December 13, 2016, the Court denied the Class’s motion to reconsider that decision.  If you did not opt out of the Class, you are bound by the Court’s rulings as to the Class claims.  Class counsel plan to appeal the Court’s rulings dismissing the Class claims.  The appellate process may take 12-18 months.  In the meantime, Class counsel remain counsel for the Class and can answer your questions.
